Lionel Messi did not win either the Liga or the Champions League this year, but he has finally won a legal battle over trade mark rights to his name and logo. By a judgment of 17September 2020, the Court of Justice dismissed an application for the annulment of a General Court decision that had confirmed the rejection of an opposition based on the trade mark ‘Massi’ registered by a Spanish company for cycling equipment and clothing.
Legal context and facts
By an application filed on 8August 2011, Lionel Andres Messi Cuccittini (‘the applicant’) sought to register the figurative mark ‘MESSI’ for various goods in Classes9, 25 and 28. The application was opposed by the owner of the trade marks Massi (a Spanish company that sells cycling equipment and clothing), which are also registered for goods in Classes9, 25 and 28.
